Accounting for Accountability
The Penn State Board of Trustees paid Freeh Sporkin & Sullivan, LLP $6.5 million dollars for the 267-page document commonly known as the Freeh Report. The Report has come under intense scrutiny in the two months since its release and the veracity of the report has been questioned by concerned alumni, as well as by numerous legal authorities. Perhaps in response to the substantial limitations and errors that have been documented to exist in the Report, the Board has now taken the stance that it will not review the entire document but will only focus on the 18 pages of Chapter 10: Recommendations for University Governance, Administration, and the Protection of Children in University Facilities and Programs.
At an approximate cost of $24,344.57 per page, this seems at first glance to be a waste of $6,061,798. According to Penn State's own figures, this is enough money to have covered the yearly salaries of 54.5 assistant professors or 242.5 graduate teaching assistants, or to fund a year of education for 273 Penn State freshmen. This is more than twice the amount spent to establish the Penn State Hershey Center for the Protection of Children.
However, could even the $6 million figure be misleading?

Mike McQueary - Reality Challenged?
I've been slogging through the Mike McQueary testimony and the cross-examination of Karl Rominger for a couple of days now and it's tedious going.
I can't quite decide which is worse - McQueary's obfuscation and sometimes obvious evasion - pretending he doesn't understand the question OR Rominger's bizarre seemingly purposeful ineptitude and lack of focus.

CORBETT APPROVAL ON SMSS INVESTIGATION AT 17%
PHILADELPHIA (Reuters) - Most Pennsylvania voters give Governor Tom Corbett fair or poor marks for his investigation, as state attorney general, into reports that former Penn State University assistant football coach Jerry Sandusky was sexually abusing children, a poll showed on Wednesday.
Only 17 percent of the state's voters think Corbett, who served as Pennsylvania's top prosecutor for two terms before becoming governor in 2011, did a good or excellent job investigating what became a scandal that shook college football, according to the Franklin & Marshall College Poll.
Some 65 percent said Corbett did a fair or poor job on the case that led to Sandusky's conviction in June for sexually abusing 10 boys over 15 years.
G. Terry Madonna, the poll director, said the results reflect a sense that Corbett, a Republican who faces re-election in 2014, did not move the grand jury investigation fast enough and that he did not put enough manpower into the probe.
There are also questions about Corbett's decision to serve on Penn State's board of trustees after being elected governor, he said.
"The prospects that this will be over any time soon are not very good," Madonna said.

HARRISBURG, Pa. -- A judge on Wednesday upheld perjury charges against two Penn State administrators accused of lying to a grand jury that investigated allegations ex-assistant football coach Jerry Sandusky sexually abused children.Some of us still believe the Attorney General will withdraw those charges prior to any trial given what she has to work with and the danger of trying to use Mike McQueary as her star witness.
Dauphin County Judge Todd Hoover ruled against the motions by former vice president Gary Schultz and athletic director Tim Curley that would have thrown out the count of perjury against each man.
The judge did not rule on the other count they each face, failure to properly report suspected child abuse. In that case, the defendants have argued the statute of limitations has expired. The judge said that dismissal request would be ruled on separately.
The judge said the claim made by Schultz and Curley that there is insufficient evidence to corroborate the perjury charges will be more appropriately pursued during the trial. He also said prosecutors have given the defendants sufficient information about which parts of their grand jury testimony make up the perjury allegation.

If elected, she made very clear to me that she intends to immediately begin an investigation into the handling of the Sandusky matter by the AG's office. She also believes that Tom Corbett delayed the investigation so that he could get elected and then during the investigation he ignored the role of the Second Mile due to the political contributions he received from members of the Second Mile Board, She was critical of his use of the Grand Jury. She believes that Corbett is really after Spanier for personal reasons. I shared with her that I felt that the Penn State community simply wants due process and the truth. For the sake of disclosure, I am a registered Republican who actively supported the candidacy of Tom Corbett for Governor. If we have any chance of uncovering the truth, we need to see Kathleen Kane elected Attorney General of PA.

Remember back last bleak November, how Joe Paterno was going to hold his regular Tuesday morning press conference following the Presentment on the 7th - but it was cancelled?
Have you wondered why that press conference was never held leaving the media doubting Joe because he would not speak to them?
Some said it was evidence of Joe's complicity in events described in the Presentment, suggesting he was afraid to face them.
New information supplied by credible sources has made it clear that one man acting alone was responsible for the cancellation of that Tuesday press conference prior to the board convening on Wednesday night.
Monday’s presentment press conference had Attorney General Linda Kelly standing next to pictures of Tim Curley, Gary Schultz and Jerry Sandusky while she announced that Penn State was complicit in the abuse of children going undiscovered for many years.
Kelly said Mike McQueary saw a boy being subjected to anal intercourse in the showers of a PSU locker room, adding that Paterno was informed of a blatant sex act by McQueary who also told Schultz and Curley. The two administrators were indicted for their failure to report the sexual abuse and of lying to the Grand Jury to save PSU embarrassment and bad publicity that would follow such a revelation.
By Tuesday morning, Joe Paterno was preparing for far more than his regularly scheduled press conference knowing he would be questioned about the Sandusky situation. Paterno was anxious to explain what he knew and answer any questions. One man, on his own, without any vote by the board canceled the press conference and thus end the best opportunity for Joe to put the media on notice that Kelly’s version of events was distorted and incomplete - that Mike McQueary never told him about any anal intercourse. Joe knew he had done the right thing.

Joe Posnanski's
reflection on Joe Paterno's life in the biography Paterno accomplishes a rare feat for non-fiction: it is
extremely well researched and well written, engaging and informative, and will
please none of its readers. The Paterno haters will despise the fact that
it is NOT a 373 page indictment of Joe Paterno, the devil that was created in
November 2011 by some of the real villains of this tragedy. No grand
conspiracy of silence is revealed, no cover up, no evidence a great coach and
teacher willfully put the souls of young children on the back burner for the
greater glory of football..
Nor will the millions of alumni and adoring fans be pleased
by reliving the 2 months of hell the Board of Trustees laid at Paterno's feet
as he was dying of cancer. Ultimately, Posnanski perfectly captures the
tough but moral landscape in which Paterno was raised, and the 2 driving forces
of his life that served as both virtues and deep flaws: Joe's need to
live up to his parents' expectations (and his constant doubt he was doing so);
and his unwavering belief in the goodness and potential of those around
him. It was this latter trait, coupled
with his sense of fair play and due process, which ultimately created a tragic
blind spot when it came to the cunning child predator in his midst, Jerry
Sandusky.

The Sept. 2 CDT editorial “Moving forward key to campaign” is right to support the adoption of the Freeh report recommendations for improving governance at Penn State. What is taking so long?
The Freeh report was published in mid-July and the board of trustees agreed to implement its recommendations.
As stated in the report, the board should immediately require full and public disclosure of members’ financial relationships between themselves, their businesses and the university.
Give board members university email addresses and make them known to the public.
In the next two weeks, the board should improve communication with the university community.
The most recent policy on the 30-minute, 10- question approach must be accompanied by at least one open town hall meeting per quarter, per region — without prescreening questions. And the schedule for the coming year should be announced and posted on Penn State websites.
The board should increase and publicize the ways individuals can convey messages and concerns to board members and should review, develop and adopt an ethics/conflict of interest policy. This policy should include recusal of members voting on issues that may be perceived as conflicts of interest. A “perceived conflict of interest” is determined by using a reasonable- person standard.
Given the amount of divisiveness in the Penn State community, we cannot move on without honest, open communications between the board of trustees and the parties it represents.
It needs to start today.

First let me say I am not a PSU alumni but just a big fan since 1968. My experience at PSU is limited to tailgating and seeing games. But I do have a sense of history and can tell all PSU students and Alumni what this BOT is leaving them with this “Move On” position of theirs.
I’m old enough to remember when SMU got the death penalty. It has been over 30 years since that happened and to this day if the SMU score is given or the initials SMU are seen most people think “Death Penalty and Cheating”. And that happened over 30 years ago.
With the situation here for PSU it’s different. There was not one NCAA rule broken yet PSU received sanctions that will cripple the program for years after the sanctions are lifted.
Let me be very clear on this next point. Please do not imagine what I’m about to tell you isn’t going to happen. It will.
If this “Move on” position is accepted whenever the PSU score is given or anyone mentions Penn State the people of your age will automatically think “Pedophile State University. The university that let a Child Molester roam free for 14 years.” will come to everyone’s mind. And that memory will last for over 50 years. Think I’m wrong? Why then if you talk to anybody in my generation do we remember SMU like it was yesterday? That Pedophile U issue will last your lifetime and beyond. Don’t fool yourself for one minute that it won’t. The media has also switched if you’ve noticed. It's not Joe as much anymore. It's now “If the PEOPLE at Penn State cared as much about kids as they do….”. Go ahead and read the story about removing the JS brick and see how the articles portray Penn State now. You, the rest of the student body and everyone who works there is now in the same boat with Sandusky.
That is the result of moving on. Because moving on says “Yes we’re guilty. We all had a hand in molesting those kids". Well if you listen to Karen Peetz with her “We have to take responsibility and move on” what is she really saying? We’re the guilty people. We have to take responsibility. Who is we? We is you. So ask yourself what do YOU need to take responsibility for? Did you Molest those kids? Please tell me what you need to take responsibility for. I think the answer is “I don’t have to take responsibility for anything". But Ms. Peetz seems to think so. Her belief is founded in the belief the Freeh report is absolutely true.
The fact is the Freeh Report doesn't come within a mile of the truth. It seems every week a new attorney posts a review of the Freeh Report online that rips it to shreds. Truth? Ha. It’s an indictment based on no facts or truth. Go on and see if you can find one review by a competent attorney who says the Freeh Report is credible. You won't find it. And you want the legacy of "Pedophile U" to follow you for 50 or more years based on that report? A report the "Move On" faction certifies to the rest of the country as the truth. Yes, Ms. Peetz and the rest of the Old Guard Bot don't come out and say that. But this action of “moving on” says that to everyone in the country.
And here is something else for you enjoy from the “Move On” strategy. When you leave Penn State you will hopefully gain employment in the field you worked so hard to get a degree in. And provided the respective employer doesn’t discriminate against you for going to Penn State. But think about when you are in the lunch room, at the water cooler, etc. and the subject of University’s attended, or the games that were played over the weekend comes up and your co-workers say I went to Notre Dame, Maryland what have you. You know you will have apprehension saying you graduated for Penn State and may even catch a few remarks like “Oh isn’t that the University that covered up for a child molester?” I hope that doesn’t happen but those same co-workers will be thinking it.
By moving on you set yourself up for what I describe above.
On the other hand how about the truth? Not a report based on opinion and Mr. Freeh's imagination. You, Penn State, Joe, Curly, Shulz, and Spanier have been slandered by lies and falsehoods to sell news articles and your BOT has supported these lies and falsehoods by their silence and desire to sweep it all under the rug and "Move On". But the truth can clear yours, Penn State, Joe and everyone's name. Wouldn't that be better than "Moving on" and the rest of the country saying “they accepted everything so it must be true”?
In closing you can choose the legacy the BOT is making for you based on lies and a bogus report. Or you can demand the truth and hold your BOT accountable for their actions. Your actions will dictate your choice. Help us make the BOT come clean, eat their giant piece of Humble Pie, admit their mistakes, and if those mistakes are severe enough resign and get true leaders who will put the welfare of Penn State, you and the Alumni before their self-interest.
Take action. Help us and more importantly yourself. Help our petition drive to get 30,000 or more signatures opposing this “Move On’ position meant to save face for the BOT. Distribute it through the dorms, frat houses, sorority houses and e-mail the links to the on-line version to people you can’t reach face to face. All the information about mailing the Petitions is at the bottom of the forms.
Just so you know that for 100's of thousands of us we can't move forward by leaving behind those who got us here.

Franco Harris said today that while he has doubts about the Freeh Report, he would be willing to change his opinion of Joe Paterno based on that report as well as other information that might be revealed in future trials of Penn State officials.
Harris, who just returned from a trip to Texas, said he has only caught pieces of information about the Freeh Report from ESPN and CNN and has not yet had a chance to comb through the information released Thursday morning on Paterno and other Penn State officials.
"Oh, oh, sure. Yeah. As I said, we just want the truth," he said about changing his opinion on Paterno. "I don't think it's complete yet."
Harris, the former Steeler and Penn State football star who played for Paterno from 1969-71, was one of the coach's staunchest defenders when the Penn State Board of Trustees fired Paterno in November 2011 in the wake of the child sex abuse scandal involving Jerry Sandusky.
"There's some players in this who are still very, very important, who were a part of this all.. . . ," Harris said in an interview in his office in McCandless. "I'm just not making a decision and I'm definitely not making a decision based on the Freeh Report."
Harris said he questioned the integrity of the Freeh Report after emails from Penn State officials were leaked prior to the reports's release. One of those emails indicated that Paterno played a role in a decision not to notify authorities of a report that Sandusky assaulted a young boy in a locker room shower.
"I mean, they really lost me on the importance of it once they started doing things like that," Harris said of the leaked email. "They lost me as far as the integrity of it. What are they really trying to accomplish here?"
