WE WON - Analyzing the Result of the PSU Board of Trustee's Elections

The success of the "reform and hold responsible" PS4RS candidates for Board of Trustees is only another step for those of us who worked hard to secure their election. We now need to support them with suggestions and help consolidate the collective power of the only popularly elected members of that body. Congratulations to the new board members.

Now there are NINE -  NINE popularly elected new Penn State Trustees since the 11/9/11 Board who, under the "guidance" of John Surma and the control of Tom Corbett, voted to destroy the reputation of the great institution they had a fiduciary duty to defend.

The Onward and Upward "MOVE ON" oriented candidates included Myers, Dan Cocco, Julie Harris McHugh, and Matt Schuyler.  UpwardState used some rather devious tactics, such as using photographs of protesting Alumni at the March4Truth, to misrepresent their position about moving forward.  The tactics didn't work.

Cocco and McHugh scored 3800 and 3500 votes respectively - less than half the total of Bob Jubelirer, who was smeared with negative campaign tactics.
Joel N. Myers - the sole 11/9/11 Trustee who sought re-election scored 3500 votes after spending thousands. His role in the 11/9/11 disaster was clearly repudiated by the Alumni.   

Ryan Bagwell (who is responsible for obtaining the emails that exposed the 11/9 members) and Rudy Glocker (endorsed by Sue Paterno)  scored a respectable 3400 and 2700 votes - votes that can be counted against the "move on" movement. 

Ted Sebastianelli - organizer of a group proposing a Joe Paterno statue - and obviously opposed to the "move on" agenda, scored 5700 votes in 4th place. 

So put another way Move On candidates - Myers, Cocco, and McHugh totaled roughly 11,000 votes total  or an average of 3500 votes each while reform and "HOLD RESPONSIBLE" candidates totaled roughly 43,000 votes or 14,000 voters x3 for reform and responsibility. 

Of the Penn State Alumni who cared enough to pay attention and vote on a very basic difference in position and opinion:

3,500 wanted to "move on"   

14,000 want those responsible held accountable

That's 20% vs 80% 

That isn't just a simple victory for the forces of right vs wrong - It is a MANDATE giving the reform trustees a base of support within the Alumni that is powerful and focused on an agenda holding the perpetrators of the 11/9/11 agenda responsible. 

The winning candidates won the PS4RS primary and were thus endorsed by PS4RS. The PS4RS group has spawned additional groups with some differences of opinion on details and tactics like PSU Re-BoT, March4Truth, Put the JoePa Statue Back, and PSU Alumni for Re-Organization of the BoT. But all of these groups were unanimously opposed to the "move on" agenda of the well funded Onward and Upward State groups. The Facebook Pages and websites for the various "Reform and Hold Responsible" groups see significant daily activity.  

This SMSS website is approaching 1.5 million visits this month (the 26th of active existence). That's  60,000 visits a month from Penn Staters who want the TRUTH about what was done to their Alma Mater by Tom Corbett, John Surma and their partners in crime (Ken Frazier, Karen Peetz, the Corbett appointees, etc) exposed.  We supported the "Reform and Hold Responsible" Candidates in order to sustain the 'hold responsible' agenda.  

Only NINE of the Trustees are popularly elected. They alone have a constituency of concerned Penn State Alumni who care about their University - not the interests of corporations or politicians who control their appointments. 

The next move for those who want to hold the 11/9/11 BoT responsible for the damage done - and alter the negative narrative spawned by the Corbett-conflicted 11/9/11 board - is to get actively involved in the defeat of Tom Corbett.  Our impact in damaging Corbett should convince a new Governor to consider our advice on his appointed replacements - as well as reform measures being considered to downsize the BoT and make it more responsive to students and alumni, as opposed to business interests. 

When 80% of the active concerned alumni demonstrate their support with their votes and hard work - these new trustees join the previous six with a significant power base they alone enjoy. These reform trustees were not appointed or chosen by Ag or Business groups - they were elected with a mandate to right the wrong done to Penn State by Tom Corbett and his cronies. This election demonstrates our power to effect change. We need to help set an agenda that makes the best use of that power. 

SMSS will have some suggestions that could alter the narrative during this upcoming election cycle. We herein initiate a discussion of tactics that might re-open the debate in the Commonwealth concerning Penn State's culpability in the Second Mile Sandusky Scandal. 

The election offers an opportunity to focus on Corbett's conflicted agenda that failed to investigate The Second Mile and the Dept of Public Welfare while attempting to blame Penn State. Corbett's failure to protect the children of the Commonwealth by failing to investigate TSM and DPW is a great campaign issue for us. 

A media focused on the gubernatorial election would have to cover 1) Corbett's clear Conflict of Interests concerning Penn State and 2) Corbett's part in the Freeh Fiction. 3) Corbett's clear failure to investigate TSM and DPW - the real agencies that failed the children of the Commonwealth.  Once the public sees how Corbett manipulated this crisis to harm Penn State, everything will be exposed to public view. That will be a very good thing and I think we can help make that happen with the help of the elected BoT members. 

In my view the gubernatorial election not only offers a chance for a new governor to replace a large number of 11/9 Trustees - done right, it could afford reform and responsibility forces input in who replaces them. 

But perhaps more importantly,  this election offers the last best chance to alter the narrative in the Commonwealth concerning Penn State's culpability in what should have always been known as the Second Mile Sandusky Scandal by focusing attention on Corbett's failure to protect children who were failed by The Second Mile and PA's child protection agencies.

And how can we explain or even understand her actions ?  

By all biographical and outward signs, Cynthia Baldwin is a major success story:

PSU BA in English 1966, MA in Amer. Lit 1974. Worked as a teacher, English professor and Asst. Dean of Students at PSU's Greater Allegheny Campus. JD from Duquesne 1983, Prosecuting Attorney Bureau of Consumer Protection. First black woman elected to the Allegheny County Court of Common Pleas 1989 - 2006. Appointed interim Supreme Court Justice by Governor Ed Rendell.Jan 2008 Duane Morris, LLP -. appellate litigation non-profit issues. VP / General Counsel at PSU Jan 2010 to announced resignation in Jan 2012   President PSU Alumni Assn 1989-91.and Chair of the Board of Trustees 2004-07.

What happened to Cynthia Baldwin seems a complete mystery? 

Continuing yesterday's  PROSECUTION or PERSECUTION - CONSPIRACY of SILENCE we can compare Graham Spanier, Tim Culey and Gary Schultz's actions to Cynthia Baldwin - the person these administrators believed was representing them and Penn State at the Grand Jury.

PSU President Graham Spanier was a good friend and benefactor to Cynthia, putting her name forward for several awards and honors over his 16 years at the helm of PSU. He approved her request to resign from the board and take over as in-house General Counsel & VP when the Board decided to go with in-house counsel in January 2010. Turns out that may be the biggest mistake Graham ever made. 

In 2012, Graham Spanier was under review for a very high security clearance from the Department of Defense and the Intelligence community, since he was involved with:

National Security Higher Education Advisory Board,

The National Counterintelligence Working Group, and

The Board of Advisors for the President at the Naval Postgraduate School & War College

Baldwin told the federal Office of Personnel Management in early 2012 that Spanier was very smart, “a man of integrity,” and “very forthcoming and open” with the board of trustees. 
About six months later she testified before a grand jury that Spanier told a series of lies and misleading statements before and after Sandusky was arrested in late 2011. 

How does that make any sense, Cynthia? How can a person make 180 degree opposite claims in 6 months. In early 2012 Spanier is a "forthcoming open man of integrity" - half a year later he's a "misleading liar". 

When you read the POST HEARING MEMORANDUM from Graham Spanier's Attorneys you will be even more astounded at Cynthia Baldwin's behavior and statements along with the court's acceptance of this behavior. Typically I would not suggest a full reading of a long legal document, but this one is simply astounding. Some excerpts:

In Nov of 2012 mere weeks prior to relinquishing the office to which she was appointed by Tom Corbett, Linda Kelly once again takes the stage to proffer charges against Penn State's former President Graham Spanier and to alter the charges against former AD Tim Curley and VP Gary Schultz. 

SMSS was on this development prior to the typical staged circus designed by Kelly et al to maximize the theater for the chattering hyena class sometimes known as the media. Once again she fills her stage with a large supporting cast, this time featuring more uniforms than a meeting of the Chiefs of Staff. 

One thing leaps out at us from the beginning when taking more than a cursory glance at this freak show. What exactly was the motive for this Conspiracy of Silence touted by the Freeh Fiction and the Persecution? Why would covering for an ex-coach no longer on the payroll of PSU be of the slightest benefit to Graham Spanier, Tim Curley or Gary Schultz? Please keep that in mind as you delve deeper into this morass of prevarications.

Prosecutors are “shepherds of justice.” When a government lawyer, with enormous resources at his or her disposal, abuses power and ignores ethical standards, he or she undermines public trust and inflicts damage beyond calculation to our system of justice. This consequence, alone, compels the responsible and ethical exercise of this power.

CORBETT, KELLY, BEEMER, FINA, BALDWIN, and FREEH

These 5 PROSECUTORS have the wealth and power of the entire Commonwealth of Pennsylvania at their disposal and, in the case of prosecutor Freeh, 8.2 million Penn State dollars that he used to trash The Penn State Culture. 

CORBETT and BALDWIN both hold or held positions on the Penn State Board of Trustees. 
CORBETT became GOVERNOR.
BALDWIN was the GENERAL COUNSEL for Penn State University.

CORBETT was ATTORNEY GENERAL when the Grand Jury was convened. 
KELLY was CORBETT'S hand picked successor. She did not seek election.
BEEMER was KELLY'S chief of staff. 
FINA was lead prosecutor on the Curley, Schultz, and Spanier cases until he resigned. 
BEEMER took over for FINA.

PROSECUTORS PLAN NOVEMBER 5 PRESS CONFERENCE TO PERSECUTE PENN STATE

Well ... to hell with writing with reserved respect for the subjects of this essay. These malicious mendicants feeding from the public trough don't deserve polite measured consideration. These are bottom-feeding mutants on steroids, unfit for reason or respect. The Commonwealth has had more than its fair share of slimy creatures dredged up from permanently smoldering underground coal pits and fracking contaminated aquifers, particularly the prosecutors and judges who seem to flourish while committing some of the most heinous crimes in memory, crimes against children -- KIDS FOR CASH. 

CORBETT is a real piece of work. You can contemplate his Lebanon Valley BA and St Mary's Law Degree, as the absolute minimum requirement. His stint as counsel for Waste Management is so odorous that he has wiped it from his bio. As a prosecutor, Corbett is ethically unfit by the standards set forth by the American Bar Association: 

“ The duty of a prosecuting attorney is not to persecute, but to prosecute, and that he should endeavor to protect the innocent as well as to prosecute the guilty. He should always be interested in seeing that the truth and the right shall prevail….”

The muddy, blood-spattered path from prosecutor to higher political office is well worn and often traveled. PA politicians have plumbed the furthest depths of this sewer more often than most. It's an obvious route, where vastly superior resources in staff and wealth are pitted against individuals forced to pay hideous amounts of money to well-connected mouthpieces or suffer the consequences of representation by a court-appointed well meaning dullard of less than equal wit with none of the resources. Prosecutors have all the advantage and, too often, pursue publicity or a high conviction rate at the expense of truth or justice. The announcement yesterday of the great achievement of the FOR THE FUTURE campaign reminds us of when that campaign began back in April of 2010.

Penn State sets $2 billion goal for campaign to help students

April 23, 2010  University Park, Pa. – President Graham Spanier announced that Penn State will aim to secure $2 billion by 2014 to ensure that the University can continue to offer an outstanding education to students from every economic background while benefiting the public through research and service.

 Penn State raises more than $2 billion in For the Future campaign

April 12, 2014 -- Penn State doubled the amount collected in its last 7 year drive, became one of only 12 public universities in the country to exceed $2 billion in a fundraising campaign, and convinced more alumni to donate along the way than in any other campaign in the nation.

Graham Spanier's 16 year tenure as Penn State University just keeps on giving. We have to wonder why it had to stop. A brief history lesson that should be known to all Penn Staters. 

Joel Myers vs Graham Spanier - THE PENN STATE CULTURE

Saturday April 11, 2014, In an article on State College dot com, Joel Myers is credited with the following remarks:

"..... three former Penn State administrators, including former President Graham Spanier currently face criminal charges for allegedly trying to cover-up the Sandusky scandal. The board decided to terminate Spanier in the wake of the scandal. 

Joel Myers says Graham Spanier had too much authority at Penn State. 

"Here we had a situation where the board had to act over a couple of days and it became obvious Graham Spanier hadn't kept the board informed," Myers says. "Graham Spanier had a lot of authority, he had in retrospect far too much. ... Obviously he didn't keep the board informed with things they should know about." 

In response, Lubrano challenged Myers, saying the board should be held responsible for allowing Paterno and Spanier to have too much power. Myers argued the board took responsibility with its actions to remove Paterno and Spanier as well as moves to reform the communication and organizational models of the board and administration."

These remarks come along with his justification for the firing of Joe Paterno -- a subject this website has covered in copious detail. Everything that we need to know about Joe's correct and appropriate action has been discussed in great detail repeatedly. We have been remiss in not considering Graham Spanier's role in what happened at Penn State.

It is our contention that, had the Board followed Dr. Spanier's lead, Penn State would be in a far better position today -- morally, ethically, and financially.  Dr. Spanier did two things about which we are certain:  1) He told John Surma that firing Joe Paterno would be a terrible mistake; and 2) He publicly announced his full support of AD Tim Curley and VP Gary Schultz.

Spanier called the allegations against Sandusky "troubling" and added that Curley and Schultz had his unconditional support.  He predicted they would be exonerated.  "I have known and worked daily with Tim and Gary for more than 16 years," Spanier said. "I have complete confidence in how they handled the allegations..." 

Despite knowing the personal risk Spanier did the right thing - and the BOT fired him for it while Corbett's AG indicted him.

2 1/2 years later, those comments appear to have been absolutely appropriate. 

By contrast, the Board (including Joel Myers) acted in a panic, driven by a media tsunami that was set off by the lies contained in then-Attorney General Linda Kelly's Presentment. The Presentment contained the fabrication that Mike McQueary saw a boy "being subjected to anal intercourse" and told Joe Paterno, Tim Curley and Gary Schultz exactly that. The Board reacted based on those lies and that media pressure. When the Trustees fired Joe and Graham, they sent a message to the world that the Penn State Board believed these key employees to be guilty. That act signaled the world,that the Trustees accepted liability on behalf of the University for the crimes of Jerry Sandusky -- a man who had not been employed by PSU for 11 years. 

CORBETT, SURMA, FRAZIER, TOMALIS & BALDWIN - UNCOMMONLY CLEAR CONFLICTS OF INTEREST PART 1 A

Eight days after the Nov 9, 2011 firing of Joe Paterno and Graham Spanier, Corbett, Frazier, Surma, Garban, and Balwin had Louis Freeh in place as the "INDEPENDENT" executioner for Penn State demanding complete collusion with Attorney General of Pennsylvania Linda Kelly.  

"The hiring of Louis Freeh is synonymous with an institution paying $8.2 million to concoct evidence supporting its own guilt and liability. Why would any institution in its right mind fund such an effort? It's insanity, clearly demonstrating the conflicted interests that are the point of this article. The Freeh insanity depicts Penn State as a schizophrenic trying to convict itself of a crime imagined in the fevered mind of its own alter-ego, the Board of Trustees."

the roots of the damaging decisions of the Board of Trustees were exposed, showing why Corbett, Surma and Corbett's appointees should have recused themselves from the Nov 9th meeting that resulted in the termination of President Spanier and Joe Paterno.

Although I have followed these events very closely since Linda Kelly's Presentment drew my interest on Nov 5, 2011; I was very surprised to find the enclosed documents among the 300 made available by Ryan Bagwell. They verify the 8 day timeline and actually confirm the effort to restrict the special investigation group to a tightly controlled Cobett conflicted few. 

If you want further confirmation that the events of Nov 9, 2011 were a well-planned and executed strategy on the part of the Attorney General turned Governor Tom Corbett and his willing Joe hating partner John Surma, then take a quick look at this timeline. Have you ever seen any sizable governing body move this quickly?

TIMELINE  NOV 5, 2011 Penn State stands accused at the moment Linda Kelly decides to put equal sized posters of AD Tim Curley and VP Gary Schultz on her Presentment stage along side of a poster of Jerry Sandusky,  There was simply no equivalence involved in the crimes of which they are accused thus the display was part of a strategy to anchor a narrative of PSU enabling Sandusky's abuse.

The verifiable LIE in that presentment; that Mike McQueary saw a boy being "subjected to anal rape" on the Penn State campus was tied to Curley and Schultz in another LIE - that McQueary told this to Joe Paterno and then to the two PSU administrators.  Those lies created the media tsunami that made Penn State the equal villain in the public eye.

Tom Corbett Embarrassed Trustee

Tom Corbett served as Attorney General for the Commonwealth of Pennsylvania from 2004 until he assumed office as Governor on January 18, 2011.

The Governor is automatically placed on the Penn State Board of Trustees. He also appoints six (6) members, in addition to his choices for PA Secretaries of Education, Conservation, and Agriculture, who sit on the Board along with a non-voting personal representative. This block of Trustees depends on the Governor for their positions, effectively making him the single most powerful presence in both voting power and influence.


Six (6) members of the Board are known as Business and Industry Trustees. These members are "self -selected" by an arcane procedure far from being transparent or apparent to those outside the process. Another six (6) members of the Board are known as Agriculture Trustees, who are selected through a county-by-county vote of the Commonwealth's agricultural societies (i.e., the PA Grange and the PA Farm Bureau).  We will discuss the business relationships of most of these members and the influence the Governor holds over them in our next installment.

Nine (9) members are elected by Alumni, the most independent and democratically selected group. That's only 9 members to attempt to balance 11 of the Governor's directly controlled members plus 6 each from Business & Industry and from Agriculture.

VICTOR B SURMA DIES IN NEW YORK JAN 26, 2014 ------- THE SURMA VENDETTA REVISITED

Back in September of 2012 we posted two stories that have been two of the most read in the history of this website. Tragic news came to our attention over a week ago that led us to revisit this information and it's effect on the defamation suffered by Penn State. As you read this information we ask two very important questions: Was it proper for John Surma to lead the Board of Trustees to fire Joe Paterno? Was John Surma's action during that meeting influenced by what had happened to his nephew Victor B. Surma? 

For a week we have had multiple independent sources telling us in confidence that Victor Benjamin Surma dIed of a heroin overdose and the Surma family had gone to considerable lengths to keep his death quiet. There was no public notice or obituary - only word of a closed small private memorial service for family and the closest of friends. We have hesitated to publish this information out of sympathy for the family. Finally tonight an obituary for Victor B. Surma appeared in the Pittsburgh Tribune.

Victor B. Surma, of Upper St. Clair and New York City, N.Y., passed away earlier this year in Manhattan, N.Y. Born July 20, 1983, he was a son of Dr. Victor J. and Kathy (Keim) Surma;

We found a Facebook statement that Vic died on Jan 26, 2014 written by his mother Kathy Surma on March 28th and we suspect that is why an obituary has finally been published.

Victor Surma, Sr. went on a PSU football message board and posted disparaging remarks about Coach Joe Paterno after his son left the football team.   According to reliable sources, John Surma had been pushing for the ouster of Paterno ever since joining the PSU BOT in 2007 and led the way to orchestrate the firing of Coach Paterno on Nov. 9, 2011. That action caused terrible damage to Penn State and the Paterno legacy and family. We believe there is strong evidence of a direct connection between these events and at the very least John Surma had a conflict of interest that should have excluded him from any part in that decision.

Joe Paterno preached personal responsibility to all of his players and staff. It is not the place of a football coach to control the personal lives of players. Vic Surma the father says Paterno 'destroyed the self-esteem and confidence of young players'. But it was Vic, the father, that decided his son should walk on at Penn State instead of taking a full scholarship at Kent State. Vic the son simply was not equipped to win playing time at a top Division 1 program. Did Vic's failure to succeed given the pressure from his father destroy his self esteem and confidence?  Or was that the fault of Joe Paterno?

John Surma, Vice-chairman of the Trustees took over for Chairman Steve Garban that fateful night in November following Linda Kelly's Presentment press conference. Garban excused himself because he was once a player for Paterno.  It appeared that Surma and Gov Corbett had planned the firing of Joe Paterno well in advance of that emergency meeting. Corbett as the past AG knew what was coming and of Surma's strong dislike for Joe. Railroading the Trustees was easy - Corbett appointees along with the inner circle controlled Board decisions. Those who had any concern over the firing were quickly silenced and told that Corbett as former Attorney General had inside information concerning the extent of involvement by Paterno and PSU administrators. After all, Corbett convened the Grand Jury that wrote the indictments, so his conflict of interest is impossible to overstate. Here, the former Attorney General responsible for building the case against PSU, had become the most powerful member of the Board responsible for protecting the interests of PSU.

On a Return to Active Participation

Following a full year of obsessive posting on the travesty of the Paterno/Penn State vilification and the failure of the PA State Government, the Penn State Board of Trustees and the Fact Freeh Fiction I finally hit the complete burnout stage at the end of 2012. I made a deal with myself and friends/family here in Knoxville to take a break I thought would be only a month or two but became a full year.

This was not because of any lack of faith or commitment to the cause this weblog represents. I am still completely convinced of the "rightness" and validity of the views that have been expressed on this site. The Second Mile Sandusky Scandal site was my creation starting in January of 2012 following 2 months of contributing to Black Shoe Diaries on the subject of the scandal. During the year it grew to over 1,000,000 visits and became one of the most read voices on the right side of the Penn State controversy. The FREEHdom Fighters grew into an effective and active group of defenders of Penn State and Joe Paterno against the outrageous failure of the Penn State Board of Trustees and the criminal duplicity of the Governor of PA and his hired hitman Louis Freeh. I am proud to have been part of that effort as an outsider with no ties to Penn State University.

The two things that I did right were to have enlisted Ray Blehar as a full partner in the effort as co-author and "owner" of the weblog in July 2012 and the formation of the FREEHdom Fighters. This is more their success than mine. As we have seen my absence was possible because of their efforts and I thank them for keeping the fire going and holding down the fort while I took a long break. I am particularly thankful for all others who have inquired about my well-being and helped keep things moving forward in my absence. This has truly become a group effort where many have taken ownership and made this thing "ours" instead of mine. That is what I always thought would be the best thing that could happen.

Ray Blehar has been amazing. His unique talent for analysis and clear illumination of a very complex situation has made this weblog the focal point and source for accurate information concerning this horrible chapter in the history of a fine institution. The people of Penn State have been abused and sorely misused by their own Board of Trustees under the control of a truly evil Governor and former FBI Director. These people deserve to be exposed and disgraced for their part in this travesty of justice and their failure to protect the children of Pennsylvania.

Over the next few weeks I intend to get back into reading everything and will soon be back to making some effort to write and provide content as I did in the past. I have missed the interaction with my Penn State friends and look forward to being part of the effort again. I hope to be around for the resolution of the cases against Tim Curley, Gary Schultz and Graham Spanier and the light they shed on the situation along with Graham Spanier's case against the FREEH FICTION for defamation and the Paterno Case vs the NCAA.

One thing of which I am quite certain is that we have been right. We have helped to uncover a great many overlooked facts that vindicate Joe Paterno and others and repudiate the words and actions of the Board of Trustees including the Governor. We were once a small voice against a tide of misinformation and blame. Those people were wrong and I feel that we have been instrumental in helping to keep the hope alive that the truth would out. That was well worth the time, effort and stress involved but there is much to be done. I hope to be a part of that in some small way again.

Outsider's View of PSU and the National Narrative

I am a 65 year old Tennessee graduate and fan who's only ties to Pennsylvania was a year spent in Sayer, Pa in 2002. My father was a Judge and political figure in Tennessee and I attended law school there for a time. Dad was a past president of the UT Alumni Association and I know something about the love of a university and it's football program. I know first hand how those institutions can sometimes protect themselves to the detriment of others but I do not believe that is what was happening in State College in the wake of Jerry Sandusky
Perhaps some people can dismiss those who object to what is being touted in the national press from PSU alumni and students as misplaced loyalty but they can't dismiss it from an outsider on those terms. I have no ties or particular love for PSU or JoePa. But I am appalled at the knee jerk reactions of much of the media and political figures who have created a rush to judgment of Mike McQueary and Joe Paterno and the good people at PSU.
